Terms and Conditions

1. Introduction
Welcome to Almeida Racing Academy, operated by Suellio Almeida ("we," "us," or "our").
By creating an account, purchasing a membership, or accessing our platform and community (collectively, "Services"), you agree to these Terms and Conditions ("Terms").
If you do not agree, you must discontinue use immediately.
2. Membership Model
Almeida Racing Academy operates on a membership-based access system.
We no longer sell individual courses or one-time programs.
Membership Terms
Free Account: Limited access to selected content, community features, and promotions.
Monthly Membership: Recurring monthly payment for full platform access and benefits of respective type.
Quarterly Membership: Recurring quarterly payment for full platform access and benefits of respective type.
Yearly Membership: Recurring annual payment for full platform access and benefits of respective type.
Prices for memberships can vary. Check our latest promotions for latest prices.
Membership Types
Free Membership: Users with a Free Membership have a limited amount of access to courses and content we provide.
We reserve the right to modify, restrict, or remove free access at any time without notice.
Gold Membership: Users with a Gold membership have full access to everything under Sim Racing. Gold members do not have access to Motorsports Program.

Lap Guides
Platinum Membership: (Coming soon) users with a Platinum membership will have full access to everything on the platform all together. This includes everything under Gold Membership. But adds access to:
Motorsports courses
Motorsports exercises
Monthly Mentorship call
Monthly Lap review
Students can change their membership plan at any time. If they decide to upgrade to a higher tier, they will be required to pay the difference for the upgrade. Their original payment for their current subscription will be prorated.
For example: If user upgrades from Yearly Gold to Yearly Platinum, and they have 3 months left of their term. They will be required to pay the 3 months left of Platinum minus what they paid for their Gold membership.
Membership Access
Your membership grants you a non-transferable, non-exclusive, and revocable license to use our digital content and community resources for personal educational purposes only.
We may introduce or modify membership benefits, tiers, or access features at any time.
3. Legacy Accounts
Users who previously purchased Lifetime Content or Lifetime Gold Memberships are recognized as Legacy Members.
Legacy Members retain ownership and access rights to the specific course(s) or content they purchased prior to the membership model change.
Legacy Account Rights
Legacy Members will continue to have access to their paid content indefinitely, even if they cancel or do not maintain an active membership.
No additional fees or subscriptions are required to retain access to previously purchased Lifetime Content.
Legacy status does not extend to new features, memberships, or future premium releases beyond the scope of the original purchase.

MRC Owner: Paid lifetime access to The Motor Racing Checklist.
As an additional thank you from the Staff of Almeida Racing Academy, we have granted these users free access to the new Car Handling Series.
RCC Owner: Paid lifetime access to The Racecraft Checklist
As an additional thank you from the Staff of Almeida Racing Academy, we have granted these users free access to the new Racecraft Series (When it is released)
Motorsports owner: Paid Lifetime access to the Motorsports Program
Lifetime Gold Members: Paid a lifetime payment to the Gold membership of the Academy.
They are granted full access to what a paid Gold member would get with no subscription needed.
Some students may have some combination of the above content. They will be granted their combination.
4. Payment and Billing
a. Payment Methods
We accept major credit cards and other payment methods listed at checkout.
All fees must be paid in full at the time of purchase or on the recurring billing date.
b. Automatic Renewal
Your membership renews automatically unless canceled before the renewal date.
By subscribing, you authorize us (and our payment processor) to charge your chosen payment method on a recurring basis.
c. No Refund Policy
All membership fees are non-refundable, including partial periods, unused time, or early cancellation.
Refunds are only issued if legally required under applicable consumer protection laws.
d. Failed payments
We will attempt to collect payments. If payments fail, access to content may be restricted depending on their type of account and what the payment was for.
5. Cancellation
You may cancel your membership at any time through your account settings.
Access remains active until the end of the current billing period, and no future charges will apply.
Deleting your account or ceasing to use the platform does not cancel your subscription automatically.
User Conduct
When participating in any Almeida Racing Academy Services, events, or communities (including Discord, Kajabi, or in-game leagues), you agree to:
Show respect, sportsmanship, and professionalism toward others.
Follow event and community rules.
Avoid harassment, discrimination, spam, or self-promotion.
Not engage in cheating, hacking, or exploiting platforms.
Not distribute or copy content without authorization.
Violations may result in account suspension or permanent bans without refund.
7. Treatment of Staff and Representatives
You agree to treat all instructors, moderators, and company representatives with respect.
Abusive, threatening, or defamatory communication will result in immediate termination of access without refund, and legal action may be pursued where applicable.
8. Intellectual Property
All content on Almeida Racing Academy—including text, graphics, videos, audio, and materials—is protected by international copyright and trademark laws.
You may not reproduce, distribute, record, or resell any content or materials without written permission.
All rights are reserved by Suellio Almeida.
By submitting feedback or suggestions, you grant Almeida Racing Academy a perpetual, royalty-free license to use and adapt your input without obligation or compensation.
9. Content and Media Usage
By participating in our leagues, coaching, or community events, you agree that your participation may be recorded, streamed, or featured on platforms such as YouTube, Twitch, and social media for promotional purposes.
By submitting testimonials, reviews, or feedback, you grant permission for us to use them in marketing materials.
10. Data Protection and Privacy
We collect and process limited personal data (such as name, email, and payment information) to provide our Services.
We comply with international data protection laws including the GDPR (EU), PIPEDA (Canada), and equivalent global frameworks.
Your data is stored securely and never sold to third parties.

If you reside in the European Economic Area (EEA), you have the right to access, correct, or delete your personal data.

11. Limitation of Liability
To the fullest extent permitted by law, Almeida Racing Academy and its affiliates are not liable for any indirect, incidental, or consequential damages, including but not limited to:
Loss of data or revenue
Interrupted access or technical issues
Dissatisfaction with performance or results
You use our Services at your own risk.
12. Disclaimers
Our training, coaching, and educational content are intended for informational purposes only.
We make no guarantees of specific performance outcomes, racing results, or personal achievements.
13. Termination of Service
We reserve the right to suspend or terminate any account, without refund, for:
Breach of these Terms
Misuse of content
Harassment or misconduct
Violation of applicable laws
We may also modify or discontinue parts of our Services at any time.
14. Modifications to Terms
We may update these Terms periodically.
Continued use after updates constitutes acceptance of the new Terms.
The latest version will always be available on our website.
15. International Use and Compliance
Our Services are accessible worldwide.
You are responsible for ensuring that your use complies with local laws and regulations in your country.
If prohibited by your jurisdiction, you must not use our Services.
16. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
Disputes shall be resolved exclusively in the courts of Toronto, Ontario, Canada.
International users agree that Canadian law governs the contract regardless of their place of residence.
